Before you begin

The key points

  • FL-180 is the Judgment, not the opening Petition.
  • Attachments carry the property, support, and parenting terms.
  • Final papers require court review and approval.
  • Check the actual date marital status ends.
01

Read the Judgment together with its attachments

The face of FL-180 is not necessarily the entire set of final orders. In an agreed case, a written settlement is attached, with forms addressing the relevant issues.

Property and debt terms, spousal support, and any custody or child support orders need to be complete and consistent. The California catalog identifies FL-341 for parenting orders, FL-342 for child support, and FL-343 for spousal or family support when applicable.

Read every referenced attachment before signing a proposed agreement. If a page is missing or says something different from what you understood, resolve it before submission. The agreement article explains that drafting stage.

02

Who prepares the proposed final papers

In a self-represented agreed case, the filers prepare and submit the final documents. The court does not finish the packet simply because an agreement exists or the waiting period has passed.

The set can include FL-170, FL-180, FL-190, and supporting forms, depending on the posture. FL-182 is the Judgment Checklist. Use the instructions for whether a Response was filed, a default is requested, or the joint petition route is used.

The forms article groups documents by stage so the opening papers are not mistaken for the whole case.

03

Complete the prerequisites before requesting approval

The court needs the required service and disclosure record as well as the proposed orders. In a standard case, service is distinct from filing. Preliminary financial disclosure remains required in an agreed case.

FL-141 records service of disclosure documents. Final disclosure can be waived through FL-144 when permitted, but that does not remove preliminary disclosure. Check the actual judgment checklist and local instructions.

A default with agreement has its own requirements, including notarization of the respondent’s agreement signature under the court’s instructions. Do not turn the absence of notarization for Judgment signatures into a rule for every attachment.

04

Submission, review, and the date your marriage ends

Submit the required copies and return envelopes or follow the court’s electronic process. The court reviews the packet and can return it for correction. In an agreed case, written declarations may allow review without a hearing.

FL-190, Notice of Entry of Judgment, provides notice after the Judgment is entered. Read the final documents for the marital status termination date rather than assuming the mailing date is the divorce date.

For standard cases, the minimum period runs from service or appearance, whichever occurs first. Joint petitions follow their filing-based rule. The timeline article explains why neither document preparation nor time alone finalizes a marriage.

05

Check what needs to happen after entry

A Judgment can create obligations that still need to be carried out. A property award is not always the same administrative task as changing a title or completing a retirement-plan order.

Check the agreement and attachments for the actions required. A home transfer, loan, or pension can need separate documents or professional help. Do not assume the court sends updates to every financial institution.

If an agency needs proof of an order, ask the court about a certified copy. This article concerns the content and entry of the Judgment rather than searching for divorce records.

A few more answers

Common questions

Is a filed Petition proof that I am divorced?

No. The Petition begins the standard case. The Judgment and relevant notices belong to the final stage. Check the court’s final documents for the date marital status ends.

Does FL-180 contain every term on its first pages?

Not necessarily. The Judgment can incorporate a written agreement and additional order attachments. Read the full set, including the pages referenced on the main form.

Will the court write our agreement for us?

Self-represented spouses need to prepare the required proposed final papers for an agreed case. Court review does not replace a complete agreement or the required forms and attachments.

What if the proposed Judgment is returned?

Read the correction notice and address the stated problems. Check consistency, signatures, attachments, and the service and disclosure record. Passing the minimum waiting period does not cure an incomplete submission.

Does the Judgment automatically update every account?

Do not assume so. Follow the required steps for each title, plan, agency, or account. Some property transfers and retirement divisions need separate documents beyond the divorce Judgment.
