The key points
- A standard case counts from service or appearance, whichever is earlier.
- A joint petition uses a filing-based minimum of 6 months and 1 day.
- Summary dissolution has separate eligibility requirements.
- No route turns a questionnaire into a final judgment.
Separate the legal minimum from the time spent doing the work
In a standard divorce, the minimum runs from service of the summons and petition or the respondent’s appearance, whichever occurs first. Filing FL-100 alone does not usually begin it. Delay in completing service can therefore matter.
The FL-700 joint petition has no initial service step. Its information sheet identifies the earliest divorce date as 6 months and 1 day after filing. These are different starting events, not competing promises about delivery speed.
Use the timeline article for the complete distinction. The final court documents determine the date marital status ends.
Choose a route because you qualify for it
The standard route uses FL-100 and FL-110. A joint petition uses FL-700 and FL-710 when spouses begin together and plan to finish with a full agreement. Summary dissolution uses FL-800 and additional eligibility conditions.
Summary dissolution is not simply another name for an uncontested divorce. It has limits involving marriage length, children, pregnancy, real estate, property, debts, and support. Do not choose the shorter packet without checking every condition.
The joint filing article compares FL-700 with summary dissolution. Neither is a way to avoid the applicable minimum period.
Complete the prerequisites while the clock runs
Use the time to exchange preliminary financial disclosures, resolve the terms, and prepare the judgment package. Waiting until the minimum expires to start these tasks can leave a case unfinished for longer.
- Confirm the proper county and local forms.
- Complete legally valid service on the standard route.
- Keep filed proof of service and disclosure records.
- Resolve property, debts, support, and any children.
- Check final documents against the written agreement.
A disagreement needs to be resolved rather than hidden in a packet marked agreed. If cooperation breaks down, get help about the correct procedure.
Check the judgment packet before submitting it
An agreed case can be reviewed on declarations and a written agreement. Judgment Checklist (FL-182) helps identify the required documents. FL-180 is the Judgment, and its attachments must match the orders requested.
Missing signatures, attachments, proof of service, disclosure records, or inconsistent terms can lead to corrections. Check the local submission instructions too. An electronic upload is not the same as a court approving the judgment.
Read what the final Judgment does before treating the initial petition as the complete case.
Avoid a completion-date promise that nobody can support
The court’s review schedule and the facts of the case affect the finish date. This site does not publish an invented statewide processing average or promise that a complete packet will be approved on a particular day.
Document preparation can help organize forms, but cannot change the legal minimum or control court review. A short marriage, no children, or an urgent personal plan does not by itself make a standard divorce final sooner.
If you need a court decision while the divorce is open, ask about the appropriate interim procedure. Do not substitute a request for speed for an actual order.
Common questions
Can both spouses agree to waive the minimum?
Agreement does not remove the statutory minimum. Spouses can work on disclosures and final papers during the period, but a court judgment and the applicable timing rule remain necessary.
Is online preparation an expedited court procedure?
No. It is a way to prepare documents. It does not create a separate court track, move a case ahead in the court’s review queue, or finalize the marriage.
Does a joint petition always finish sooner?
It removes initial service from the opening procedure, but still needs disclosures, a full agreement to finish that way, and a judgment. The actual finish depends on the work and court processing.
Does summary dissolution avoid the waiting period?
No. It is a separate procedure with strict eligibility limits and a filing-based waiting period. A smaller document set does not mean an immediate divorce.
What should I do when final papers are returned?
Read the correction instructions, address the identified issues, and use the appropriate checklist. Do not assume the passage of the minimum period cures missing or inconsistent documents.
