The key points

  • Classification comes before deciding how an asset is divided.
  • The date of separation can matter to property and debt questions.
  • A retirement award can need a plan-specific order.
  • Support is a separate issue from the division of property.
01

Identify community and separate interests

California generally treats earnings and acquisitions during marriage before separation as community property. Property from before marriage and gifts or inheritances to one spouse are generally separate. An asset may contain both kinds of interests.

These categories are not always resolved by the name on an account or title. Gather the relevant dates and records before proposing a division. Do not assume a single label on a form answers a question about mixed funds.

Preliminary disclosures require an account of assets and debts. FL-142 and FL-160 are the formats identified in the California catalog. Use the forms article for their place in the process.

02

Address the house as several connected decisions

A home raises questions about ownership, value, the mortgage, occupancy, and the steps to carry out a transfer or sale. Agreeing who keeps the keys does not answer all of them.

A transfer may require recorder documents, including a deed and Preliminary Change of Ownership Report, that may be needed for a transfer. These are not substitutes for the divorce agreement. Deeds can involve notarization and local recorder requirements.

An agreement allocating a joint debt does not by itself bind the lender or remove a borrower. Ask about the loan and the transfer documents before relying on a promise to change names later.

03

Describe debts and retirement accounts specifically

List the accounts and obligations that must be divided or confirmed. A debt allocation in a Judgment can create responsibilities between spouses while a creditor may still pursue people liable on the account.

A pension or workplace plan can need a Qualified Domestic Relations Order or another plan-specific order. The divorce Judgment and a general agreement may not be enough to make the plan pay benefits to a different person.

Get help about plan rules, valuation, and the correct order. Do not use a generic document template as proof that every pension or retirement account can be divided in the same way.

04

Treat spousal support as its own decision

Support after divorce can involve ordering payments, reserving the court’s ability to award support later, or terminating that ability. Those choices have different consequences.

Long-term support depends on relevant circumstances, including marriage length, income, earning capacity, need, and ability to pay. It should not be treated as an automatic percentage of a property award or a quick calculator result.

The catalog includes FL-343 for appropriate support orders. Get individual advice before agreeing to a waiver or termination of future support jurisdiction. A cooperative case can still involve an important rights decision.

05

Make the agreement and follow-up steps match

Write clear terms about what each person receives, pays, signs, or transfers. Match those terms to the proposed Judgment and relevant attachments. Include the required financial disclosure record.

Consider whether the agreement depends on a lender, plan administrator, or recorder taking an additional action. Check what is actually required rather than assuming the Judgment updates every institution.

Read writing the agreement for how the pieces are submitted together. A document preparation service can record supported answers, but cannot decide a disputed ownership or support issue.

Common questions

Does California’s property rule mean every asset is cut in half?

Do not start with that assumption. First identify community and separate interests, any mixed interests, and the relevant records. The classification and the terms of a valid agreement matter to the final orders.

Does keeping the house take my spouse off the mortgage?

A divorce allocation does not by itself rewrite a lender’s contract. Check the loan arrangements and the actions required for any transfer or refinancing rather than relying on the property clause alone.

Is the Judgment enough to split a pension?

A retirement plan can require its own order. Ask about the plan’s rules and the appropriate professional help before assuming a general property sentence completes the division.

Is child support included in spousal support?

They are different subjects with different orders and requirements. An agreement involving children must address their care and financial support as well as any spousal support decision.

Can we agree to no support without advice?

You can discuss terms, but understand the effect of a waiver, reservation, or termination before signing. Those are different choices. Seek individual advice if you do not understand their consequences.
